Przedstawiony poniżej Regulamin Ogólny (Section 1 i Section 2), ze względu na europejski charakter przedsięwzięcia Energy2B, napisany został w języku angielskim. Żadne z postanowień niniejszego Regulaminu Ogólnego korzystania z platformy internetowej Energy2B nie zostały skonstruowane w celu przekazania jakichkolwiek praw osobom trzecim.

Regulamnin Szczegółowy (Section 3) stworzony został w trosce o prawa własności intelektualnej studentów Politechniki Łódzkiej i ze względu na lokalny charakter obowiązywania napisano go w języku polskim.

Regulamin Ogólny

For the purposes of browsing and using the online services of the website Energy2B (http://www.Energy2B.eu) and its related (sub)domains, the following terms and conditions apply.

Section 1: General Terms and Conditions

Consent: As a visitor or member (registered user; registered student; registered expert; registered energy challenger with or without the registration support of the Energy2B local coordinator) of Energy2B, you agree with the terms and conditions below either by visiting the site, or by using the site, or by registering as a member. Enegy2B can change these conditions at any time. Modified versions will take effect thirty (30) days after being published on this website.

Membership: By registering (as a student; as an expert; as an energy challenger with or without the registration support of the Energy2B local coordinator) you agree that you are providing correct, accurate and true information, and that you have the legal competence to conclude such an agreement. Minors should have the permission of one of their parents or legal guardian before registering. In any case, you should be 17 or older to register on Energy2B. Energy2B is at liberty to cancel your membership at any time, for any reason and without prior warning. All members are liable for the consequences of using this site. Energy2B may cease to provide the service, as well as block or delete a membership at any time and without warning. In the case of a conflict with one or more other (non) members, Energy2B will not be liable for any damages, of any kind, in the present or in the future, anticipated or unanticipated, known or unknown, that are the result of or concern the said conflict. You cannot use this website in an irregular manner, for any unlawful purpose or any purpose contrary to the conditions and warnings in this text or in any other text. You have to use the entire website as a normal, careful and reasonable human being.

Public data restrictions: All public data cannot be in violation of any law or statute. You explicitly accept this statement and you are responsible (according to civil and criminal law) for the data, text and pictures that you publish. All data you upload or post cannot violate or infringe upon the rights of authors, patents, trademarks or trade secrets, or the property, intellectual, privacy, personality or publicity rights of a third party. All data you upload or post cannot be misleading, threatening, defamatory or tormenting. The following acts are prohibited by law and, thus, subject to punishment: 1. Racism, xenophobia, negationism, and discrimination (prison sentences). Racist remarks, propagating discrimination of sexual preferences, publishing racist pictures or insulting foreigners are forbidden on Energy2B. 2. Public offences, publishing sexually suggestive pictures, pedophilia, offering prostitution or escort services and implicit or explicit invitations for sexual activities. 3. Uploading pornographic, sexually suggestive or overtly erotic pictures/text is forbidden. Invitations for sexual activities in public or by private messages are also prohibited. Humorous or caricatural pictures can be an exception, as long as the humorous character is predominant. 4. Slander, defamation, stalking, abusing someone's name or picture, abuse of confidence, etc. are prohibited by law and subject to punishment. Therefore, using abusive language, insults, abusing someone's name or picture, slander and defamation are forbidden on Energy2B as well. It is strictly forbidden to publish messages or pictures with damaging, threatening, misleading, defamatory, rancorous, aggressive, racist, vulgar, denigrating, indecent, insulting, violent, obscene or pornographic content. It is forbidden to use the site for purely political, religious or commercial purposes. References to political parties and the publishing of flags will be punished if it's clear that there are political or inflammatory purposes behind it. Discussions on political/religious points of view are allowed, if they don't degenerate. On Enery2B you can only publish content (pictures, text, films, etc.) for which you hold the necessary copyrights. You are solely responsible for obtaining these rights. Energ2yB cannot be held liable if you do publish content for which you don't hold the rights. Energy2B will impose sanctions when notified of content that infringes upon the rights of third parties. Disturbing the public order on the web site means that spamming, recruiting votes, sending unsolicited commercials or chain letters, in private or public messages, unlawfully reloading pages, flooding or writing excessively long texts, etc. can be prosecuted. Do not behave in a way that is inappropriate or detrimental towards the other users of Energy2B. (Trying to) hack(ing) Energy2B or the account of a Energy2B member is prohibited and punishable. In this situation, we always inform the police, even when you are a minor. By committing such offences, you risk getting a prison sentence and/or monetary fine. Except for abuses such as slander and defamation, which can only be prosecuted after a complaint by the victim, Energy2B can initiate action to end forbidden practices. Energy2B is lawfully obliged to report indictable offences to the appropriate law enforcement agency(ies).

Complaints procedure: You are required to report any detrimental or illegal information/public data found on our site to via the online contact forms in a timely manner. If Energy2B considers your complaint about content posted by another member to be justified, any offending content will be removed (text, images, information or data). The complaints procedure is in accordance with article 14 of the EU-directive 2000/31/CE concerning electronic commerce.

Copyright: All text, pictures, images, drawings and graphics on this website are copyright protected. Usage whatsoever requires permission from Energy2B. When a user enters data that is meant to be viewable to the public, including but not limited to text, pictures, images, drawings or graphics for a profile, entries for Energy2B services, comment entry, a review, etcetera, the user grants Energy2B an unlimited licence to disseminate, use, process, translate or modify this data. Anyone may add a link to this website or to individual products or pages on this site, without consent. Exceptions are the use of frames and/or any technique which makes it unclear to a visitor on which website he/she is browsing.

Liability: Energy2B reserves all rights and denies any liability whatsoever. Enegy2B provides no guarantees explicit or implied of the reliability, safety or recommended nature of the service. All rights are reserved, except for those explicitly deniedEnegy2B denies all responsibility and restricts its liability to the legal minimum concerning the content or nature of publications or the damage that may follow from it. Energy2B cannot and does not guarantee that Energy2B will function uninterruptedly and without errors. Enegy2B does not give any guarantees neither about the results of using this website, nor about the reliability or correctness of the information that can be found. We try to keep Energy2B up, bug-free, and safe, but you use it at your own risk. This site is provided on an “as is” and “as available” basis. Energy2B doesn't give any guarantee about the functionality of this site, the information, the content, the materials or the products that are presented on this site. To the extent allowed by law, Energy2B rejects any guarantee, explicit or implicit, including but not restricted to implicit guarantees of saleability and suitability for a particular cause. Energy2B cannot be held responsible for any kind of damage resulting from the use of this website, including but not restricted to direct or indirect damage. As a user, you assume complete responsibility and liability, without protest, for any information you publish and/or any activity in which you engage on or via your profile. Links to other websites, including banners, buttons and text links, are subject to the responsibility and liability of the owner of the links. Energy2B can prevent the linking to other websites and can prosecute if these are not according to personal, normal and non-commercial use.

Access: The use of usernames, logins, passwords and/or entry codes (from now on "login data") is the sole responsibility of the user. The user is required to maintain the confidentiality and security of the login data. The user is required to immediately inform Energy2B of a breach or abuse of login data.

Jurisdiction: This agreement and the relationship between you and this site shall be governed by the local national laws without regard to its conflict of law provisions. You and Energy2B agree to submit to the personal and exclusive jurisdiction of the courts located within the country where the Energy2B service is offered to the consent.

Section 2: Energy2B Competition and Idea Factory Terms and Conditions

Definitions

Current Student: a current student is a student from any subject area who is registered at the university formally taking part in the Energy2B initiative. This includes undergraduate and postgraduate students. Current student status will be verified on entry to the Energy2B Competition and the Energy2B Idea Factory.

Graduating in 2010/2011: this term refers to students graduating or due to graduate from the course (either undergraduate or postgraduate) of the university formally taking part in the Energy2B initiative during the 2011 academic calendar year.

Contestants: those current students who register themselves on the Energy2B platform and make usage of the available services and content.

Contestant information: this term refers collectively to the Intellectual Property Rights and other information contained within a contestant’s submission and plans.

Permitted purpose: this term refers to the use of contestant information for the purposes of judging the Energy2B Competition and the Energy2B Idea Factory and any other purposes mentioned explicitly within this document.

Energy2B Idea Factory: service of the Energy2B platform where the contestants can post in public an idea as a solution for the energy challenge posted by the energy challenger.

Energy challenge: a question or case where an energy challenge is asking in public a solution from the contestants.

Energy Challenger: those organisations that post (or let post) in public a energy challenge on the Energy2B platform.

Idea Factory Entry: a public posting of a contestant on a public energy challenge.

Idea Factory Vote: a public vote for an idea factory entry by contestants other than the contestant who posted the public idea factory entry.

The Energy2B Competition 2010/2011is hereafter referred to as the Competition. This relates specifically to the competition held in the 2010/2011 calendar year.

Local Competition Cycle 1: this term refers to the first cycle of local competition for current students of the university taking part of the Energy2B initiative and comprises Local Competition Round 1, Local Competition Round 2 and Bootcamp 1.

Local Competition Cycle 2: this term refers to the Second cycle of local competition (01 Mar 2011 to 30 Apr 2011) for current students of the university taking part of the Energy2B initiative and comprises: Local Competition Round 1, Local Competition Round 2 and Bootcamp 2.

Local Competition Round 1: this term refers to the round at which students enter the competition by completing predefined fields. Competition dates are available on the Energy2B web platform.

Local Round 1 Competition Winners: this term refers to the Contestants who are chosen by the expert panel to progress to Round 2. The expert’s decision is final.

Local Competition Round 2: this term refers to the second round in which Local Round 1 Competition Winners progress with their original idea from Round 1 to Round 2. Competition dates are available on the Energy2B web platform.

Local Round 2 Competition Winners: this term refers to the contestants who are chosen by the expert panel to progress to Bootcamp. The expert’s decision is final.

Bootcamp: this term refers to a one-day workshop with expert input and feedback on student ideas/solutions plus coaching.

Competition Finalists: this term refers to the students who are chosen by the expert panel as having the top ideas and will progress to the European Round.
European Round: this term refers to the final round which will include Local Round 2 Competition Winners who have attended a Bootcamp, from all participating universities.

General rules regarding Energy2B Competition and Idea Factory

Contestants are advised that all competition entries and responses to energy challenges in the idea factory will be made by completing the online forms on the Energy2B platform. Entries will only be valid when terms and conditions are accepted online and when completing the entry forms.

Any entries received from contestants who have not agreed to the terms and conditions will be null and void.

Any current employee of the university taking part in the Energy2B initiative, Energy2B team member, contractor or worker, energy challenger are not permitted to enter the Competitions or Idea factory.

It is the responsibility of the contestants to ensure they have the right to exploit the intellectual property rights (IPR) and any other information (collectively Contestant Information) contained in their submissions and plans and have taken appropriate steps to protect it and secure any necessary consent(s) so that such Contestant Information may be used by for the purposes of judging the Competition and any other purposes set out in these rules or other documents mentioned herein (the Permitted Purpose).

Energy2B may at its discretion without notice or reason refuse to proceed with a competition entry or solution to a energy challenge in the idea factory if it considers such use may cause the university taking part in the Energy2B initiative or Energy2B to be in breach of a third party’s rights in any Contestant Information connected with a competition entry / solution to energy challenge. In such circumstances Energy2B may be obliged to cooperate with any third party whose rights may have been prejudiced as a consequence of the use of the Contestant Information.

All contestants (including the winners) must seek written approval from Energy2B prior to releasing any marketing or press materials related to the Competition, Energy2B or the university taking part in the Energy2B initiative. Contestants must not use any trademarks, designs, brand and trade names or any other material which identifies or makes use of information related to the Competition, Energy2B, the university taking part in the Energy2B initiative or its staff without first seeking such permission.

Energy2B is open to those that have an energy related idea for the Competition or a solution to an energy challenge within the Idea Factory, which meet the entry and eligibility criteria set out in these terms and conditions and below.

The Competition is open to all current students and those graduating in 2010/2011. Eligibility will be checked on receipt of completed entries.

Students may enter the competition as individuals, in pairs, or in teams (up to a max. 4 students per team). Pairs or teams must nominate a leader who will register himself/herself on the platform and will receive all correspondence. Partners of the pair and all members of the team must be students of the university taking part in the Energy2B initiative.

It is the responsibility of the nominated leader to update the student profile on the Energy2B platform with any changes to their current correspondence address during the period from date of their competition entry to 30 Apr 2012.

Providing the individual, pair or team meets the criteria above, they may submit one competition entry per Competition.

Individuals, pairs or teams may submit no more than one solution to an energy challenge in the Idea Factory.

All contestants must be at pre-trading stage or have been trading for less than 12 months on 1st October 2010.

By entering the Competition you are agreeing to provide Energy2B coordinators with relevant and accurate information about yourself and your idea/solution, to enable the Energy2B coordinators to meet the data collection requirements of the funders and relevant auditors. The Energy2B coordinator reserves the right to ask for further information if required.

Appendices containing logos, designs and images can be submitted to support your competition entry (excluding round 1). Appendices used to increase the word limit shall be disregarded.

Should entries exceed the specified word limit for a section of the Competition entry form, only the words contained within the maximum word count will be shown to the expert panel. Words will be counted from the start of the relevant section. Any words exceeding the specified word count will be removed from entries prior to the judging. It is the responsibility of the entrant to ensure that their entry meets the word count for each section.

All Round 2 Competition Winners are required to attend an Energy2B Bootcamp in 2011 (Local Competition Cycle 1) or 2012 (Local Competition Cycle 2). Attendance of a workshop/bootcamp other than those designated by Energy2B will not be permitted as a substitute for this requirement.

Energy2B reserves the right to exclude entries, including but not limited to exclusion on moral, ethical or legal grounds. Such exclusions are at the discretion of Energy2B whose decision is final.

The deadline for entries is indicated on the Energy2B web platform. Competitions will close automatically on the specified dates. Late entries will not be accepted. It is the responsibility of the entrant(s) to ensure that the application is made on the web platform within the competition time frames specified on the Energy2B web platform.

Energy2B may at its discretion without notice or reason cancel the Competition or energy challenges of the Idea Factory.

Energy2B shall use reasonable endeavours to ensure the competition entries / solutions to challenges and any subsequent submissions are used only for the Permitted Purpose. Energy2B may discuss any of the information contained in an application or submission with its professional advisers, the experts or its/their staff for the Permitted Purpose only.

By entering the Competition each contestant undertakes that it/they will not at any time hereafter use, divulge or communicate to any person, except to its professional representatives or advisers or as may be required by law or any legal or regulatory authority, any confidential information concerning the business or affairs of the Energy2B authorised persons or other contestant’s information which may have or may in future come to its/their knowledge and shall use its/their reasonable endeavours to prevent the publication or disclosure of any confidential information concerning such matters.

Where required the experts will sign a confidentiality agreement prior to judging the Competition.

The experts may decide to award joint prizes. The decision of the experts is final.

Competition finalists will be required to give short presentations at Local and European Showcase Events to be arranged by Energy2B.All presentation material used by the winners shall be available for use by Energy2B for marketing purposes connected to the Competition and any press or publicity releases.

Prizes will be awarded at an event to be organized by Energy2B. Competition finalists will be required to attend this event.

Winner(s) of monetary prizes will be paid by cheque to the name of the winning business or nominated leader.Please be aware that cheques can take some weeks to arrive. If a prize is awarded which provides benefits in kind (e.g. mentoring) it is not possible to convert this to a cash prize. None of the prizes is transferable without the written consent of Energy2B.

Winners of monetary prizes must cash their prize cheque within six months of the cheque date, after this point all prizes shall become null and void.

Where required Energy2B shall treat information received on an idea / solution to challenge or business ideas confidentially. However, Energy2B reserves the right to use reasonable information about the winning business ideas, for publicity purposes, without consultation with the entrant(s).

Energy2B make no warranty or representations for themselves or on behalf of persons authorised by Energy2B for the Permitted Purpose as to the accuracy of any information supplied to the contestants during the Competition.

Nothing in these rules is intended to or shall operate to create a partnership or joint venture of any kind between Energy2B, its authorised representatives and the contestants or any of them or to authorise any party to act as agent for the other and no party shall have authority to act in the name or on behalf of or otherwise to hind the other in any way (including but not limited to the making of any representation or warranty, the assumption of any obligation or otherwise to bind the other in any way (including but not limited to the making of any representation or warranty, the assumption of any obligation or liability and the exercise of any right or power) other than as set out in these rules.

Students are advised that by entering the Competition they are agreeing to abide by these rules. For information about the Competition administration, clarification of rules and general enquires contact the local coordinator via the contact form on the Energy2B platform.

Section 3 - Regional Terms and Conditions (Postanowienia Regionalne - obowiązujące dla Studentów Politechniki Łódzkiej)

W ramach działań Konkursu Energy2B (The Energy2B Competition) obowiązują polskie przepisy prawne regulujące ochronę własności przemysłowej: 

  • Ustawa – Prawo własności przemysłowej ( Dz.U. z 2003 r., Nr 119, poz.1117 z późn. zm.)
  • Ustawa o zwalczaniu nieuczciwej konkurencji (Dz. U. z 2003 r., Nr 153, poz. 1503 z późn. zm.)
  • Ustawa o prawie autorskim i prawach pokrewnych ( Dz. U. z 2006 r., Nr 90, poz. 631 z późn. zm.)

W ramach działań Fabryki Pomysłów (Energy2B Idea Factory) Student (Current Student) przenosi autorskie prawa majątkowe na polach eksploatacji wymienionych w art. 50 Ustawy o Prawach Autorskich i Prawach Pokrewnych (Dz. U. z 2006 r., Nr 90, poz. 631 z późn. zm.) na rzecz Pomysłodawcy (Energy Challanger) Zagadnienia z dziedziny energii (Energy challange).

 Uczestnictwo w konkursie Energy2B:

  • Konkurs przeznaczony jest dla studentów Politechniki Łódzkiej.
  • Jeżeli do konkursu chce przystąpić student nie będący studentem Politechniki Łódzkiej, ale będący studentem innej polskiej uczelni wyższej, zobowiązany jest on poprosić o zgodę lokalnego koordynatora wypełniając odpowiedni formularz kontaktowy.   • Rejestracja studentów nie będących studentami Politechniki Łódzkiej wymaga przesłania koordynatorowi lokalnemu drogą e-mailową ksera ważnej legitymacji studenckiej wraz z dobrze widocznym zdjęciem jej posiadacza oraz pieczęciami/hologramami potwierdzającymi jej ważność.
  • Student nie będący studentem Politechniki Łódzkiej, który zostanie zaproszony do udziału w Szkoleniu Planowania Biznesu pokrywa koszty dojazdu, noclegu oraz wyżywienia związanego z uczestnictwem w Szkoleniu z funduszy własnych
